Terms of use and sale

1. The service

Lupoka lets you recreate viral trend videos by replacing their characters with photos you provide. Videos are generated by third-party artificial intelligence models. Results vary from one generation to the next: likeness, movements and rendering are not guaranteed to be identical. We may change the models, trends and features offered.

2. Account

The service is for people aged 18 and over. You are responsible for access to your account and for what is done with it. An account is personal.

3. Your photos and consent

• You may only upload photos of yourself, of adults who explicitly agreed to appear in the video, or of your animals.
• You must not upload photos of minors, of public figures without their authorization, or of anyone who has not agreed to appear in the video.
• You guarantee that you have these agreements and you are responsible for any claim from a person shown in your photos.

4. Prohibited content

Sexual or intimate content of real people, any image of a minor, harassment, defamation, impersonation, fraud, disinformation, hate and violence are forbidden. Any violation leads to account closure and may be reported to the authorities.

5. Automated checks and moderation

• Before each generation, your photos are analysed automatically to detect nudity and people who appear to be minors. A flagged photo is refused and no credits are charged. Model providers also apply their own filters.
• An automated check also verifies that your credits are consistent (each credit must come from a payment, a refund or a goodwill gesture). If something does not add up, generation is paused on the account while we check.
• You can contest one of these decisions by writing to [email protected].
• You can report any content or use contrary to these terms to [email protected].

6. Credits and prices

• Generations are paid with credits. The number of credits depends on the chosen model, quality and length; it is shown before you start the generation.
• Pack and subscription prices are shown in euros, taxes included, on the Pricing page. Payment is processed by Stripe; we have no access to your card details. Credits are added as soon as the payment is confirmed.
• Pack credits do not expire. Subscription credits are added at each billing period. Credits have no cash value and cannot be transferred or exchanged for money, except for the refunds described below.

7. Subscriptions

A subscription renews automatically each period. You can cancel it at any time from your dashboard ("Manage or cancel"); it stays active until the end of the current period.

8. Right of withdrawal

• You have 14 days from the purchase to withdraw, without giving any reason.
• To withdraw, send us a clear statement at [email protected], for example: "I hereby give notice that I withdraw from the contract for the purchase below. Purchased on: [date]. Account email: [email]. Name: [name]. Date: [date]."
• The refund is made no later than 14 days after we receive your request, to the payment method used.

9. Failed generations and conformity

• If a generation fails, times out or is refused by a provider's filter, the credits are returned to your balance automatically.
• You benefit from the legal guarantee of conformity for digital content and services. If a video does not match what is described, write to [email protected]: we rerun the generation, return the credits or refund you.

10. Personal, non-commercial use

Trends are humorous re-creations (parody, pastiche, caricature) of viral videos. Generated videos are for your personal, non-commercial use: you may share them on your personal social accounts, but not use them in advertising, sponsored content or any paid context.

11. Intellectual property

• You keep your rights to your photos. You allow us to use them only to generate your videos, for the period stated in the privacy policy. They are never used to train AI models.
• Reference clips, music, choreographies and trademarks belong to their owners, who do not endorse the service. You are responsible for how and where you publish your videos, and you agree to remove a published video if a rights holder or a person shown in it asks you to.

12. AI-generated content

Each video carries an invisible, machine-readable marking (watermark in the image and metadata) identifying it as AI-generated. You must not remove it. When you publish or share a video, you must clearly indicate that it was generated by AI (the platform's AI label or a mention in the caption). You must not present it as real footage or use it to deceive anyone.

13. Copyright and removal requests

Rights holders can ask for a trend or video to be removed through the "Copyright & removal" page or at [email protected]. We may remove any trend or content at any time.

14. Liability

We do our best to keep the service available and working, without being able to guarantee it is never interrupted. We are not responsible for how you use the videos or for the content you upload. Nothing in these terms limits the rights you have by law as a consumer.

15. Closing your account

• You can close your account at any time by writing to [email protected]. Your photos, videos and account data are then deleted, except what the law requires us to keep (invoices).
• We may suspend or close an account that breaches these terms. In case of a serious breach (section 3 or 4), remaining credits are not refunded.

16. Changes to these terms

We may change these terms. A purchase remains subject to the terms in force when it was made.

17. Governing law and disputes

• These terms are governed by French law. If there is a problem, write to [email protected] first.
• Failing an agreement, the dispute may be brought before the competent courts under consumer law.
